Notwithstanding anything written elsewhere in this regulation, the department may determine the rate of return for the production of cigarettes and bidis.
(2) In the case that the department has not fixed the profit rate according to sub-rule (1), the department may approve such profit rate after examining the profit rate submitted by the licensee producing cigarettes and bidis.
